Terms of Service

Last Updated: 14th January 2024

Welcome to [Driving Theory Cancellations] (“we,” “us,” or “our”). By accessing or using our website [https://drivingtheorycancellations.co.uk] (“Site”) and services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these terms, please do not use our services.

1. Service Overview

[Driving Theory Cancellations] is a standalone website operated by an individual, not a registered company. This service manually assists users in finding earlier driving theory test and driving test appointments. The service is provided independently of any government agency.

2. No Affiliation with the DVSA

We are not affiliated with, endorsed by, or connected to the Driver and Vehicle Standards Agency (DVSA). The DVSA does not support or approve the use of third-party services such as ours. All interactions with the DVSA or any related governmental services should be conducted through their official channels.

3. Service Nature

Our service is entirely manual and does not involve the use of bots, automated scripts, or any other form of automation. We use our expertise and industry knowledge to manually search for earlier test dates on your behalf. This process is designed to assist users who may not have the time or resources to check the DVSA system frequently. However, the same results could potentially be achieved by users themselves through diligent searching.

4. User Responsibilities

  • Accuracy of Information: You are responsible for providing accurate and up-to-date information, including your driving license number and contact details. Any errors in the information provided may result in failed service delivery.
  • Confirmation of Changes: It is your responsibility to verify any changes made to your test dates by logging into the DVSA system. You should not make any further arrangements (e.g., booking lessons, arranging transport) until you have received confirmation directly from the DVSA.
  • Notification of Service Lapse: If you believe that the service has not been provided (e.g., if you think we have failed to search for earlier appointments on your behalf), you must notify us immediately. We will take prompt action to rectify the situation. If you do not notify us within a reasonable time after your order, we are not liable for any lapse in service.

5. Limitations of Service

  • No Guarantee of Success: By using our service, you explicitly acknowledge and agree that there is no guarantee that we will find an earlier driving test appointment for you. While we will use our best efforts to locate an earlier test date based on your preferences, there is a chance that no such appointment will be found. You are paying for the service of us manually trying to find an earlier appointment on your behalf, but we do not guarantee that the outcome will meet your expectations or that an appointment will be found at all.
  • Service Availability: We do not guarantee that our service will be available at all times. External factors, such as DVSA website outages or changes to their booking system, may affect our ability to deliver the service.
  • Liability for Changes by DVSA: We are not responsible for any changes made by the DVSA to your test date and/or time or for the cancellation of your test.

6. Refund Policy

  • Eligibility for Refunds: If you are unhappy with the service provided, you may file a complaint with us. We will investigate thoroughly, and if we determine that the service was not provided as described, a full refund will be issued. Refund requests must be submitted within 30 days of the service completion.
  • Conditions for Refunds: Refunds will only be issued if:
    • We fail to find a suitable test date that meets your criteria within the specified period.
    • The service was not performed as described.
  • Maximum Liability: Our maximum liability to you shall not exceed the amount you have paid for our service.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Automated Interference: Attempting to interfere with our service through the use of bots, scripts, or other automated means.
  • Misrepresentation: Providing false or misleading information during the use of our service.
  • Unauthorized Use: Attempting to reverse-engineer, disassemble, or decompile any aspect of our service.

8. Indemnification

You agree to indemnify, defend, and hold harmless [Driving Theory Cancellations], its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:

  • Your use of the Service.
  • Your violation of any term of these Terms of Service.
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
  • Any claim that your use of the service caused damage to a third party.

9. Disclaimer of Warranties

  • No Warranties: We provide our services on an “as available” basis with no warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, timely, secure, or error-free.
  • Information Accuracy: We make no guarantees regarding the accuracy of the information provided through our service. Any reliance you place on such information is strictly at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Exclusion of Indirect Damages: We exclude all liability for any indirect, incidental, or consequential damages arising from the use of our service, including but not limited to loss of data, loss of profits, or missed communications from the DVSA.
  • Service Disruptions: We are not liable for any loss or damage suffered by you or any third party due to interruptions or unavailability of our service.

11. Termination Clause

[Driving Theory Cancellations] reserves the right to terminate your access to the service, without any advance notice, for conduct that [Driving Theory Cancellations], in its sole discretion, believes is in violation of these Terms of Service or is harmful to the interests of [Driving Theory Cancellations], its customers, or third parties, or for any other reason deemed appropriate.

12. Severability Clause

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

13. Force Majeure Clause

[Driving Theory Cancellations] shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond [Driving Theory Cancellations]’s reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation (including ‘line-noise’ interference).

14. Entire Agreement

These Terms of Service constitute the entire agreement between you and [Driving Theory Cancellations] with respect to the service and supersede all prior or contemporaneous understandings regarding such subject matter.

15. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Dispute Resolution

Any disputes arising out of or relating to these Terms of Service shall be resolved through binding arbitration in [Your Location], in accordance with the rules of [Arbitration Association]. The decision of the arbitrator shall be final and binding upon the parties. Each party shall bear its own costs and expenses.
